Germany’s BND Act & recent CJEU case law

After the German Constitutional Court ruled in May 2020 that key provisions in the existing BND law are unconstitutional, the legal framework of the German foreign intelligence service is currently under review. In an article on about:intel Professor Elspeth Guild, who also serves as an advisor to the GUARDINT project, and Dr. Thorsten Wetzling argue that Germany’s Constitutional Courts judgment should not be the sole reference point while amending the draft bill, greater attention ought to be paid to recent case law from the Court of Justice of the European Union (CJEU).
